1. Agreement to Terms
By accessing or using the Services provided by Your Trader ("Company", "we", "our", or "us"), including the DietScan mobile application and the yourtrader.ca website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
Your Trader is located at 11804 Abbottsfield Rd NW, Edmonton AB, T5W 3T6, Canada.
2. Description of Services
Your Trader provides mobile applications for iOS and Android devices. Our current application, DietScan, is a food ingredient analyzer that uses optical character recognition (OCR) to scan ingredient labels and analyze them against a user's personal health profile including allergies, dietary restrictions, and health conditions.
Important Disclaimer: DietScan is intended for informational purposes only. It is not a medical device and does not constitute medical advice. Always consult a qualified healthcare professional regarding food allergies, dietary needs, or medical conditions. Do not rely solely on DietScan to determine whether a food product is safe for consumption.
3. User Accounts
To use certain features of our Services, you must sign in using a Google account. By signing in, you authorize us to access basic profile information as described in our Privacy Policy. You are responsible for maintaining the security of your account and for all activities that occur under your account.
4. Subscription and Payments
4.1 Free Tier
The free tier of DietScan allows up to 5 ingredient scans. Once this limit is reached, a premium subscription is required to continue scanning.
4.2 Premium Subscription
Premium subscriptions provide unlimited scans and are billed through the Apple App Store or Google Play Store. Subscription pricing, billing cycles, and cancellation terms are governed by the respective platform's policies.
4.3 Refunds
Refund requests for in-app purchases are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble any part of the Services
- Interfere with or disrupt the integrity or performance of the Services
- Attempt to gain unauthorized access to any part of the Services
- Use automated scripts or bots to interact with the Services
- Resell or sublicense access to the Services
6. Intellectual Property
All content, features, and functionality of the Services — including but not limited to software, text, graphics, logos, and icons — are the exclusive property of Your Trader and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or completely accurate. Ingredient analysis results may contain errors and should not be used as the sole basis for food safety decisions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR TRADER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ALLERGIC REACTIONS, OR ADVERSE HEALTH EFFECTS RESULTING FROM RELIANCE ON INGREDIENT ANALYSIS RESULTS.
Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months prior to the claim.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
11. Account Termination
You may delete your account at any time through the app's Settings screen. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Services ceases immediately.
